Hello all,

I got married with an American citizen in 2004 out of love. In October 2006 we were called for an interview by USCIS. The interviewer was convinced that we loved each other and that's why we got married. However, she could not do anything before I got a waiver for 2-year-requirement (due to my J-1 visa). Both my home country government and the Department of State issued no rejection. However, I have not yet heard any response from the USCIS for nine months. Can I make this process faster in any way?

More crucially, I and my wife separated, and I want a divorce immediately. When I get the divorce, will I be deported? I am also a PhD student. If I get deported, can I get an F-1 visa and come back? How long would all that take?

I'm not an expert, but I suggest you not to divorce! Don't be silly. The US law is very strict after September 11. You may lose everything, including your PhD Degree. Get along with your wife and wait for your residence proceedings. Best regards.

I wouldn't say you would lose your Ph.D, but as far as you getting deported I would suggest going to Avvo.com and finding yourself a good immigration attorney to consult with.
