I'm married to a US Citizen, and It has been more than 8 months since the initial interview and I still haven received my GC.

In the mean time I've been able to work with the EAD, but it expired. I applied to renew my EAD while AOS is pending, and I understand that it will take about 90 days for the process. Right now my company is asking me to come back to work, and I told them that I can't.

The question is:

Can I start working again once I receive the I-797 Notice of action while waiting for the actual card?

Or what would be the penalty if I go back to work until I get the card

You should be careful of not messing up anything now in your situation, so I think you made the right choice not going back to work before you sort this out. What I recommend is that you go the local USCIS office and ask, or try to get an INFO pass appointment or just pay some dollars for an immigration lawyer. You do for sure NOT want mess anything in your situation now. JY
