> Citizen Victim Of Domestic Abuse By Immigrant Partner, Is Deportation Warranted?
I am an American citizen married to a Frenchman. I entered the marriage in good faith about two years ago. In the last year, my husband began to physically and verbally abuse me. In May, I threatened to divorce him if he didn’t stop. At the mention of divorce, the violence ceased. We spent one good month together, and I decided to help him complete form I-751, "Petition to Remove Conditions on Residence". Shortly after the petition was sent in, the violence recommenced, worse than before. My husband now claims that he married me exclusively for the green card. I am in the process of filing for a divorce, and am also considering filing charges with the police. My story appears to be a common one, but in this case it is the CITIZEN, rather than immigrant woman who has suffered from abuse.

My question is whether or not his green card may be revoked for such behavior, despite the fact that he just received it in August, 2007. It is essentially my fault for collaborating to file his petition, nevertheless, I am wondering if domestic violence on the part of the immigrant warrants deportation from the United States.

If you are being abused, report him to the police! It is that simple!!! Let the police deal with issues that are police related. In terms of immigration, yes - you should have divorced him a long time ago. But, you didn't. So, I would have contacted the USCIS and got an appointment through INFO PASS. Take copies of all the documents he has and bring it and ask what to do.
