I am a single mother currently with no job and in very hard fin. situation. My VAWA petition got approved a year ago. My driver's license has just expired since DMV granted me only 1 year DL based on my approved VAWA petition. They are refusing to renew it unless I get a new document from USCIS. USCIS is waiting for a decision of a judge in Arlington, VA about my removal proceeding which were filed against me by imi. office in Norfolk, VA about 2,5 years ago. The case has been postponed numerous times either because of judge not being present on a hearing day or other reasons. Currently my next hearing date is unknown - waiting for Arlington, VA to let me know.

So I am not able to work, I don't have money to file EAD, my driver's license is expired. Only thing I have is my approved VAWA from January 2008 and my pending AOS from June 2007. All of that is waiting for judge's decision on my case which has been taking forever. My last hearing was scheduled on Jan. 6 but after my arrival to Arlington. VA I was told the judge hasnt showed up and my hearing will be rescheduled again. (!!!!!!)Last time I talked to the judge, he told me he CAN grant me AOS, but he has to notify the office in Norfolk and wait for their response. So I waited with my EAD filing, hoping that on my next hearing I get a Green Card. This is just still not happening and I NEED TO GO TO WORK to support myself and my kids.

I need to file EAD and I need help with it, because I cannot afford to pay my lawyer.

Can anyone please help me and tell me under which category I can file (C9 - adjustment applicant) or (C14 - deferred action)? My approved VAWA should put me in deferred action. Am I eligible for a filing fee waiver? I have no way to get money to file this form unless someone lends me. Anything else I need to know before I attempt to file it by myself?

And one more thing: I used to have work approval while I was married to my ex-husband and filed AOS based on the marriage - but that didn't work out and my work approval was never extended. Do I file for a new EAD or just extension? I know it has to be under the same category to be eligible for extension, but I am so confused in this legal stuff that I do not know it this is same or different thing.
