I know of friend who overstay
tourist visa one time. Is this problem next time he go to USA? What happen if he try enter and get problem?
YOU MUST OBTAIN A VISA IN ADVANCE (B-1/B-2). DO NOT TRY TO GO TO USA WITH NO VISA IN ADVANCE. B.
I agree with bradhy76 that you should never attempt to enter the usa if you know you overstayed. You should probably get a visa in advance. Sort this thing out at home and don't go and hope for the best. The result can be tragic and just create even more problems. Why did the person overstay though? Was because of intent or accident? If you overstay but not more than 180 days you must leave the US but you can apply for a visa to return immediately. If you overstay your visa for more than 180 days you will face removal proceedings to be deported from the United States. Additionally, if you overstay for more than 180 days but less than one year then you will be inadmissible to the US for three years beyond that time and if you overstay for one year or greater you will be inadmissible for ten years.
