Last June we received a letter from USCIS stating that my
husband's case was denied and he was to leave the country because we missed our interview appointment - the thing is: WE NEVER RECEIVED THE NOTICE TO APPEAR!!!
We moved in January of the same year. I called
Immigration, like the website says, to change my address. I asked the gentleman who helped me if I needed to do anything else and he said no. Our lawyer's assistant (we never could speak to the lawyer we pay $3,500 to) even said that's all I needed to do. So USCIS claimed we never changed the address. Too bad. "If you don't like it, write your Congressman!" Officer Ortega told me as I as crying at the Miami office.
Long story short, we've been waiting since June for a court date to show the judge proof of our change of
address (my confirmation #) and hope that he feels that is sufficient. My husband's work permit has expired and his license will expire in 2 months. What can we do?!?!!? I am a US citizen and so are our 2 young children. We work, pay taxes and have done everything we were told. How do we fix this?!?!?
