I am an American Citizen currently living in Berlin Germany studying German. I met my boyfriend, a Bulgarian citizen, while living in Chicago. He is legally still married to an American citizen, although the papers have been filed for the divorce. My boyfriend and I would like to get married and since I am currently in Europe, thought it would be easier to get married in Bulgaria. I have heard that the
Green card comes much faster when the couple is married in the foreigner's home country.
My boyfriend came to the USA on a
student visa, the time
expired, but then fell in love with an American citizen and they married. The marriage did not work out, he obtained no
green card, and they are in the process of a divorce. My questions are 1) if he leaves the USA now, or after the divorce is final, is he considered illegal because he did not obtain the
green card? How will this effect his return entry to the USA. Will he be banned for a certain number of years? 2) If we married in Bulgaria, does he need to be living in Bulgaria for awhile or have a permanent residence there for a certain amount of time before we can get married? 3) If we did marry in Bulgaria, how soon would he
receive the green card and be able to return to the USA. 4) During his stay in the USA, he did have a few issues, including being arrested for possession of marijuana, it was only considered a misdemeanor and he currently has credit card debt. Will any of these issues effect me being able to marry him or his return to the USA.
