I am legally in the US with a tourist visa. I recently had a baby (father is from US) and the baby is a US citizen. Can I go home to Mexico for Christmas and return (my visa is and will be valid) with my baby? what do I need to do? thanks....

Miss Loving Life,

What is the status between yourself and the father? Are you married? If not, you should go home during the holidays and then go back to the U.S. with a K-1 fiancé visa, then get married in the U.S. and get your green card. That is probably the best thing you can do. Traveling in and out with a tourist visa may backfire. If you want to return with your tourist visa, I recommend you contact the USCIS to verify.
