Hi,
I have L1B(Individual) Visa and it is going to expire on Sep 15, 2008.

I was selected for H1B(with different employer ) this year and my petition was approved in Jun, 2008. I-94 is issued and valid from Oct 1, 2008.

As my L1B is getting expired on Sep 15, 2008, I am planning to apply for extension of L1B and once I get the L1B extension, I want to work till Dec 2008 on L1b visa and then shift to H1b status

My H1B employer is saying that either if i stay in USA [ with L1B EXTENSION ] or if I go back to India ,come on L1B visa [ applying fresh L1B ]my H1B will become invalid . Is this true???

Can H1B I-94 BE ISSUED when my L1 is expiring on 15 sep '2008 and applied as a consular notification?

kindly suggest me how to work in usa with L1b visa till dec'08 and then shift to H1visa
