To those who faced a similar situation and could provide suggestions ...

My niece was married in Dec 2005 to an IT person on a H1B visa and joined him here in April 2006. I485 was subsequently filed for her by her husband and she got her EAD with which she secured employment. She also worked for few months. For one and half years, between the time she arrived in the US till September 2007, she became the target of both physical and emotional abuse by her husband. Finally in October 2007 she was thrown out of the apartment by her husband. With no money and no transportation she lived with a distant relative for 3 weeks.

He later persuaded her to go to India with him and she went hoping the families there would help resolve the situation. Instead she was again thrown out, this time by her in-laws, and her husband became abusive towards her parents. He however kept with him all her documents, Passport, Application receipt numbers for change of status application, Advance parole, Airline tickets and all other material that she needed to come back to the US and continue her work.

He virtually abandoned her there and is now believed to be back in the US but no one can reach him, including his former employer. Even local police could not help as he already left the country. We believe it was all planned by him and his parents before he took her there. My niece is now stuck in India and neither can she come here nor inquire about her visa status from there as he kept all the necessary documents for travel and for contacting USCIS purposely with him.

Please advise us if any of you are aware of a way to deal with this situation. It is sad that a girl, for no fault of hers, has to undergo such humiliation and an educated person like her husband to behave the way he did causing so much grief to her family and has been able to get away with it.
