I am a British citizen and my husband is a US citizen. We went to an immigration attorney last October to get guidance on how to marry and move me to the USA. The attorney advised us that it was fine for me to enter the USA on a tourist visa and we should marry over 60 days later, we could then let my tourist visa expire and apply for a
marriage visa. The attorney has now told us he made a mistake and that it is not possible to go from 'no status' to applying for a marriage visa and that I have to leave the USA within the next week (in order to not incur any penalties for staying in the USA over 6 months without status) and we then have to apply for a marriage visa while I am in the UK and my husband is in the USA. Does anyone know anything about this or able to offer advice? As you can imagine this is a huge blow to us, this has been my home for nearly nine months and to have to leave my husband and home for an indefinite period of time is devastating, especially when we have paid for legal advice and thought we were doing things in a safe way.
