Fiancée and I found out that our petition for a K-1
Fiancée visa had been approved by USCIS. The next step we have been advised on is for her to complete paperwork/medical forms and attend an interview to be granted the visa. Also recently our situation has changed as she cannot commit to spending the required amount of time in the USA to be granted her Green Card. From what I understand, once the
Green Card is issued after we are married and file for adjustment of status it is a conditional Green Card which means she will have to apply for permission to travel back home to New Zealand. I was told that if she stays out of the country too long on the conditional Green Card, it could be revoked and we would be required to start this lengthy and costly process all over again.
My fiancée must return to NZ in order to take care of her sick father so I will be immigrating to New Zealand as well. Because of this we have to terminate the
K-1 visa process that we started. We are planning on getting married in New Zealand instead of the USA. How do we go about cancelling the application for the visa? I assume we will not be entitled for a refund of the $455 however, this is the least of our worries. My
fiancée currently holds a B1/B2
visa which allows her to enter the US for periods of 6 months, will cancelling the K-1 visa application affect the status of the B1/B2 visa?
Any advice regarding this matter will be greatly appreciated.
