I am a USA citizen who after 4 years of dating decided to marry a Russian girl. I married her in January 2007 the 10th in Italy, I was so happy because I had just taken a position in Puerto Rico and I wanted to be able to bring my wife with me.

Well I took a lawyer and let her firm handle all the papers and documents needed.

All my petitions were approved without any problem by the US immigration. The Immigration offices sent my approved petition to the Embassy in Moscow.

My wife was interviewed today.

Well she has been told that I need to provide another form the I 864A because with my income I could not support her.

Now let me tell you about me "financial" inability:

I am not rich, I make $80,000 a year, and the company pays for housing rent, car, phone and all expenses related to car and travelling for work.

I have a spotless credit report where my only loan is an educational loan to pay my MBA studies. The actual balance $23.000.00 with a monthly payment of $594.00 per month.

I have some credit card with high limit and very low balances if any because I try to pay in full every month. My credit score is excellent 738

I have a bank account for more than a decade with bank of America and have there about $61,000 plus some other cash in other institutions. My total cash can be estimated at about $70,000.00

My household consists just of me (since my wife is in Russia) and after taxes and loan payment my net salary is of about $49,000.00 which MORE THAN DOUBLE the 125% rule of an household of 2 which requires $21,400.00 income.

And yet they are asking for the I864A that I cant provide because:

1 - Nobody related to me lives with me
2 - I don't have anybody listed as dependant on my last year tax return - since I have no kids and I married in January.

Well I called the US embassy in Moscow today where after charging me $12.00 for a phone call did not answer my question because the lady was not prepared for this kind of question.
It is also impossible to talk to the consul. They wont give his number out, neither would they transfer my call to him.
I have been told to write a letter to a generic consul address in Moscow which I did. My concerns will be answered in "SEVERAL" days.

They also told me to get a lawyer, well I already have one and so far between lawyer fees and Gov. fees and other expenses I paid $6,000.00 already.

I have just been left in despair! Don't know what to do and EVERY SINGLE fact I described above I can Prove it with any bank document they may want to see.

Nobody helps us and there is no help. I am just left with some simple choices if they will deny my wife VISA

1 - leave my job and the USA
2 - Divorce - Which I will never seek

I take it from your words that you are currently in the US and she is on Moscow.

I would forget about any agencies oversees.
I would go to the State department and apply for a visa for your spouse.
I would write them a letter and copy the same exact letter and send it to the Immigration office, the white house, your state official, your governor and every other official you know. I would make a list of the people in that very letter and make them all know that they have all been contacted.

I did the same thing fighting for my permanent residency. After been here for 10 years, with a bachelor in criminology and applied several times for the FBI to be a linguistic assistant. (Still waiting by the way '2 years now', I speak about 10 different Arabic dialogs, lived in more than 5 Middle eastern courtiers and know more about their culture that the best of them)


Send the same exact letter to all agencies and in 7 days, send out the same one again. Soon after that wait 7 more days and send the same DAMN letter again.

Tell them you are a US citizen and you have the legal right to get your wife to this country.

P.S. include the financial state included on this post with the letter and supporting documents, pay stubs, last year taxes, student loan payments. Finish of the letter indicating the 2 the income levels requested by your state.

Good luck man, I am no lawyer, but I know right from wrong and you need to give them those evidence with conviction.


Most of the people you talk to and sick and tired of every phone call they get, they cannot wait to end the call and go on to the next one so they can go home in 8 hours. The people that can really help, and obligated to do so, don't answer phone calls.
Letters Letters Letters and more Letters.

HINT: Nothing gets a state senator more excited ( hopefully a Democrat ) Than a letter that was also sent to the White House. If he is a Republican, mention your desire to start a hard working American family.



One more last thing,
through something at them in the letter that they are not used 2.

I did this before.

“I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct.”

I used this on top of the page that had all the facts such as my file number, marriage dates, income status A registration number, password information and anything else that you thing they will need to verify your identity, status, file etc.


That sentences was copy pasted from one of their immigration forms.

sorry to hear about your problem. I will tell you that you have to do all the leg work and hiring an attorney is a waste of money. you need to contact the consulate here in the USA, you need to apply for her visa here in the USA and trust me you will have to follow up on everything you do. sending your requests via certified mail and calling as soon as it is received to ensure it is properly reviewed.

my husband is from Europe and if it wasn't for me documenting who i speak to, the time, the date, sending paperwork certified and following up, he would still be illegal.

good luck and it will all work out, it's just frustrating and time consuming to say the least
